Terms of Service

These Terms of Service ("Terms") are an agreement between you and Collaborative Endeavor, LLC, doing business as The Listing Dept ("The Listing Dept," "we," "us," or "our"). They cover your use of our website and our done-for-you listing marketing service. By creating an account, subscribing, or using the service, you agree to these Terms. Please read them.

The Listing Dept produces marketing materials for your real estate listings. You set up your branding once, then submit each listing through a short form (or by uploading an MLS sheet), and we render a complete branded package for each listing (for example, print, text, and email flyers, plus social pieces such as a carousel and a reel), and deliver it to your private folder. The exact pieces, formats, and turnaround are described on our site and we add to them over time.

You are responsible for the information you provide and for keeping your account details accurate. You agree that the branding, listings, photos, disclaimers, and other content you submit are yours to use, or that you have the rights and permissions to use them, and that they do not infringe anyone else's rights. You will not use the service for anything unlawful, misleading, or that violates the rights of others, including fair housing and advertising rules that apply to real estate marketing. You are responsible for making sure the final materials comply with the laws, MLS rules, and brokerage policies that apply to you before you use or distribute them.

You keep ownership of your branding, listing details, and photos. By submitting them, you give us the permission we need to use them to produce, quality-check, store, and deliver your materials, and to keep past versions so revisions and re-deliveries work. The finished marketing materials we deliver are yours to use for your real estate business. The templates, systems, software, and design frameworks we use to produce them remain ours.

We offer pay-per-listing pricing and monthly subscription plans, along with setup fees, per-listing overage charges, and one-time custom-template setup fees where they apply. Current prices are shown on our pricing page and at checkout. Payments are processed by Stripe. By providing a payment method, you authorize us to charge the fees that apply to your plan and usage, including per-listing overage charges above your monthly allowance and any custom-template setup fees you agree to.

For custom-template setups, we confirm the exact amount with you and send you an itemized invoice before any build starts. You pay the invoice, and then we build.

Our monthly subscriptions renew automatically. When you subscribe, you agree to the following:

I agree to a monthly subscription that renews automatically each billing period until I cancel from the Customer Portal. Cancellation takes effect at the end of the current billing period, even if I cancel mid-term.

You can cancel any time through the Stripe Customer Portal. When you cancel, your plan stays active through the end of the billing period you have already paid for, and it does not renew after that. We do not provide prorated refunds for the unused part of a billing period unless required by law. Plan changes such as downgrades take effect at the end of the current billing period.

If something is wrong with a delivery, we fix it fast. That is what the one-click revision link is for, and it solves nearly every issue. If we genuinely cannot deliver a listing you have paid for, we refund that listing. Because materials are produced on demand for each listing, fees are otherwise non-refundable once the work has been produced, and any setup fee covers your completed brand onboarding and is non-refundable. Every delivery includes a one-click revision link for changes like a price update, a swapped photo, or a new open-house date, and we keep every past version. Revisions are meant to correct and update your listing materials. Very high revision volume on a single listing may be flagged or paused so we can check in with you and make sure the process is working for you.

After the first listing, we aim to deliver most listings within an hour, and always within 48 hours, but turnaround is a target, not a guarantee, and can vary with volume, holidays, or issues outside our control. We may update, improve, or change parts of the service over time.

The service is provided "as is" and "as available." We do the work carefully and quality-check, but we do not warrant that the service will be uninterrupted, error-free, or that it will meet every requirement or produce any particular business result. You are responsible for reviewing your materials and confirming they are accurate and compliant before you use them.

To the fullest extent permitted by law, The Listing Dept and Collaborative Endeavor, LLC will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or lost business, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the three months before the claim arose.

You can stop using the service and cancel any time. We may suspend or end your access if you violate these Terms, misuse the service, or fail to pay. If we end your account, we will give you a reasonable chance to retrieve your delivered files where practical.

We may update these Terms as our service or the law changes. When we do, we will change the effective date above, and for significant changes we will notify you by email or a notice on the site. Your continued use of the service after an update means you accept the revised Terms.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the service will be handled in the courts located in North Carolina, unless the law requires otherwise.
